CNN —Voting technology company Smartmatic and the far-right network One America News said Tuesday that they had settled a defamation lawsuit stemming from the outlet’s lies about the 2020 election. “The case has been resolved pursuant to a confidential agreement,” OAN attorney Chip Babcock told CNN. The case against OAN was one of a spate of lawsuits filed against right-wing outlets in the aftermath of the election. In the wake of the 2020 presidential contest, pro-Donald Trump outlets spread lies wrongfully suggesting President Joe Biden had not been legitimately elected president. OAN settled a defamation suit in September with former Dominion executive Eric Coomer, whose case revealed how the network worked with former Trump campaign lawyer Sidney Powell and others to lie about the election.

CNN —A pro-Trump lawyer who tried to overturn the 2020 election was arrested Monday after a court hearing about her recent leak of internal emails belonging to Dominion Voting Systems. In the last 24 hours, Leaf has posted more than 2,000 internal Dominion documents on his social media account. The marshals declined to say whether they arrested her, and she didn’t answer messages seeking comment after the hearing. During the at-times testy hearing Monday, Magistrate Judge Moxila Upadhyaya peppered Lambert with sharp questions about the disputed Dominion materials. Dominion wants Lambert removed from the case and suggested in court Monday that she might have committed a crime by disseminating the files to Leaf.

CNN —The Supreme Court on Tuesday declined to revisit sanctions levied against two pro-Trump attorneys who filed frivolous lawsuits challenging the outcome of the 2020 election in Michigan. Sidney Powell and Lin Wood filed separate appeals asking the justices to review sanctions imposed by a US district court in 2021. Though their cases involved several technical arguments, both claimed sanctions would make it less likely for lawyers to take “unpopular” cases to court. The Supreme Court denied both appeals without offering any comment on the case. The 6th US Circuit Court of Appeals largely upheld the sanctions.

Former President Donald Trump faces a key week ahead, and yet again the drama won’t be on the campaign trail but in the courtroom as the GOP front-runner’s children prepare to testify before a judge. Ivanka Trump was initially listed as a co-defendant, but a New York appeals court dismissed that status, finding that the claims against her were too old. Chutkan had imposed a narrow gag order on Trump earlier this month, barring him from making public statements targeting prosecutors, court staff and potential witnesses. But she paused the gag order to allow Trump’s defense team time to argue why his speech should not be restricted. Manhattan Supreme Court Justice David B. Cohen rejected Fox Corp. and Fox News’ attempts to subpoena George Soros, his son Alex Soros, and their philanthropic organization Open Society Foundation (OSF) for documents related to the election defamation case. Fox argued that Alex and George Soros, as well as OSF, possess material necessary to the network’s defense in the defamation trial. The documentation, Fox argued, would establish a connection between George Soros and Smartmatic. “I base that on the finding that the crux of Smartmatic’s claims is that Fox has asserted they were part of rigging [the election], not that Smartmatic was affiliated with George Soros, Alex Soros, or the OSF,” Cohen said. “We’re interested in the closeness of the relationship, what Soros has done for Smartmatic over time,” Marks said.
